This policy applies to purchases made through CelebrateAndGift.com and any order that expressly incorporates this policy. It should be read together with our Terms and Conditions, Delivery Policy and Privacy Policy.

1. About This Policy
Celebrate & Gift (“C&G,” “we,” “us” or “our”) offers gifts and celebration products prepared or supplied by approved local vendors and delivered through C&G or delivery partners.
Customers purchase through C&G and should contact C&G for cancellations, complaints and remedies. Vendor or driver involvement does not require the customer to resolve the matter directly with that party.
This policy does not limit any rights or remedies that cannot legally be excluded under applicable Ontario or Canadian law. If this policy conflicts with a mandatory legal right, the mandatory legal right will prevail.
2. Products Covered
This policy covers products sold by C&G, including:
- Flowers and bouquets
- Gift baskets and hampers
- Food hampers
- Chocolates and sweets
- Cakes and desserts
- Dry fruits
- Personalized gifts
- Greeting cards
- Balloons
- Add-ons
- Other gifts and celebration products
Many of these products are perishable, made to order, personalized, sourced specifically for an order or time-sensitive. These characteristics affect whether cancellation, return or resale is reasonably possible.
3. Order Review and Customer Responsibility
Before placing an order, the customer must review:
- Product name and description
- Included contents
- Quantity
- Personalization information
- Delivery address
- Unit or apartment number
- Recipient’s name and telephone number
- Delivery date or delivery window
- Allergy or dietary information communicated to C&G
- Delivery fees
- Applicable taxes
- Final order total
The customer is responsible for providing complete and accurate information and promptly reporting any error.
An order confirmation does not guarantee final acceptance where:
- Payment fails or is reversed.
- A product or vendor becomes unavailable.
- An obvious pricing or listing error exists.
- The order cannot be safely or lawfully fulfilled.
- The delivery address is outside the supported delivery area.
If C&G cannot accept or fulfill an order, we may cancel the affected product or the entire order and refund the amount paid for the cancelled portion.
4. Cancellation by the Customer

The customer must provide the order number. A cancellation request is not approved until C&G confirms the cancellation.
We will normally approve a full cancellation if the request is received before the order is accepted for fulfillment and before any non-recoverable cost is incurred.
Cancellation may be refused or limited once:
- A vendor has accepted the order.
- Product sourcing has started.
- Preparation or arrangement has started.
- Personalization has started.
- Flowers or food have been prepared.
- A delivery partner has been assigned.
- Another non-recoverable commitment has been made.
Same-day, next-day, perishable, personalized and made-to-order products may enter preparation shortly after payment and may become non-cancellable quickly.
If partial cancellation is operationally possible, the refund may exclude the reasonable value of:
- Completed work
- Products already purchased or prepared
- Personalization already completed
- Vendor charges
- Committed delivery costs
- Other non-recoverable expenses
These deductions will only apply to the extent permitted by law.
A change in the recipient’s availability, the occasion, personal preferences or the customer’s plans does not automatically create a right to cancel after preparation begins.
5. Cancellation by C&G
C&G may cancel all or part of an order when:
- A product or vendor becomes unavailable.
- A safety or allergy concern cannot be resolved.
- Delivery is outside our service capability.
- The order appears fraudulent or unauthorized.
- Payment is declined, reversed or disputed.
- A material pricing or listing error has occurred.
- Severe weather or another serious condition prevents reasonable fulfillment.
- Fulfilling the order would violate a law, regulation or C&G policy.
C&G will notify the customer and refund the amount paid for the cancelled portion of the order.
To the extent permitted by law, C&G is not responsible for indirect or consequential losses resulting from a cancelled order.
6. Change-of-Mind Returns
Except where required by law or expressly stated on the relevant product page, C&G does not accept returns or provide refunds simply because:
- The purchaser or recipient changed their mind.
- The product is no longer wanted.
- The recipient dislikes a correctly supplied product.
- The customer ordered the wrong product.
- The customer failed to review the order information.
This rule is particularly important for:
- Perishable products
- Edible products
- Flowers
- Cakes
- Hygienic products
- Personalized products
- Custom products
- Made-to-order products
For an unopened, non-perishable and non-personalized item, C&G may choose to authorize a return as a customer-service accommodation.
Written authorization must be obtained before returning an item.
An authorized return must be:
- Unused
- Complete
- Safely returnable
- In its original condition
- In its original packaging
The return authorization will explain the return deadline, instructions and responsibility for return costs.
7. Damaged, Incorrect, Defective or Missing Products
Contact C&G as soon as reasonably possible after delivery if an order is:
- Materially damaged
- Incorrect
- Defective
- Materially incomplete
- Missing an important product or component
For perishable products, flowers, food, cakes or occasion-sensitive orders, reporting the problem within 24 hours gives us the best opportunity to verify the condition and provide a practical remedy.
A delay in reporting does not automatically remove any right that cannot legally be waived. However, it may limit our ability to determine whether damage, deterioration or improper handling occurred after delivery.
Please provide:
- The order number
- Purchaser’s contact information
- A clear description of the problem
- Photographs of the complete product
- Photographs of the damaged or affected area
- Photographs of the packaging and delivery label, when reasonably available
- Information about how the product was stored or handled after delivery, when relevant
If the complaint is verified, C&G will provide an appropriate remedy based on the circumstances.
The remedy may include:
- Correcting the order
- Delivering a missing product
- Replacing the affected product
- Redelivery
- Partial refund
- Full refund
- Another resolution agreed upon with the customer
C&G will consider:
- The type of product
- The seriousness of the problem
- The portion of the order affected
- Product availability
- The time required to provide a replacement
- Whether the occasion or intended delivery time has passed
8. Natural, Handmade and Photographic Variations
Flowers, fruit, baked goods, handmade arrangements and vendor-prepared gifts may naturally vary in:
- Colour
- Shape
- Size
- Placement
- Arrangement
- Appearance
Product photographs may also appear different because of lighting, photography and screen settings.
Minor differences that do not materially reduce the product’s quality, intended function, stated contents or overall value are not normally considered defects.
Decorative products or staging items shown in photographs are not included unless the product description states that they are included.
9. Substitutions
Local, seasonal and vendor availability may change after an order is placed.
C&G may make a minor substitution using an item of comparable or greater quality and value while preserving the product’s overall style, purpose and price.
C&G will seek customer approval before making a material substitution involving:
- The principal product type
- A major brand
- Flavour
- Product size
- Theme
- Personalization
- Another essential product feature
C&G will not knowingly substitute a product in a way that conflicts with an allergy or dietary instruction that C&G has expressly accepted.
If a material substitution is required and the customer cannot be reached, C&G may delay or cancel the affected product and issue the appropriate refund.
If an unauthorized material substitution occurs, the customer should contact C&G for review and an appropriate remedy.
10. Food, Allergies and Product Safety
Customers must review available ingredient and allergen information before placing an order.
A serious allergy or dietary requirement must be communicated to C&G before ordering.
C&G will share accepted allergy or dietary instructions with the relevant vendor. However, products may be prepared in facilities that handle common allergens.
Unless expressly confirmed in writing for the specific order, C&G does not represent that a product is:
- Allergen-free
- Free from cross-contact
- Suitable for a particular medical condition
- Prepared in a dedicated allergen-free facility
Do not consume a product that appears:
- Tampered with
- Spoiled
- Unsafe
- Incorrectly labelled
- Inconsistent with an accepted allergy instruction
Contact C&G promptly if there is a food-safety or allergy concern.
Nothing in this section limits legal rights relating to unsafe, defective or misrepresented products.
11. Delivery Delays
Delivery dates and delivery windows are estimates unless C&G expressly confirms a guaranteed delivery service in writing.
Delivery may be affected by:
- Traffic
- Weather
- Road closures
- Vendor delays
- Building access
- Recipient availability
- Vehicle problems
- Emergencies
- Events outside C&G’s reasonable control
C&G will make reasonable efforts to communicate material delays.
A delivery delay does not automatically entitle the customer to a full refund.
C&G will consider:
- The length of the delay
- The reason for the delay
- The condition of the product
- Whether the order remains useful for its stated occasion
- Whether a guaranteed service was purchased
- Any applicable legal rights
When C&G, a vendor or a delivery partner causes a material delivery failure, the remedy may include:
- Refund of the delivery fee
- Partial refund
- Replacement
- Redelivery
- Full refund
The appropriate remedy will depend on the circumstances.
12. Failed Delivery and Customer-Provided Information
Delivery may be unsuccessful if:
- The delivery address is incorrect or incomplete.
- The unit or apartment number is missing.
- Buzzer or building-access information is missing.
- The recipient’s telephone number is incorrect.
- The recipient cannot be contacted.
- The recipient is unavailable.
- The recipient refuses the delivery.
- Building access is unavailable.
- No safe and authorized drop-off location is available.
The driver may attempt to contact the recipient and purchaser.
Depending on the product’s condition and safety requirements, the driver may return, hold or safely dispose of the product.
When the failed delivery was not caused by C&G, the vendor or the driver:
- Reasonable redelivery charges may apply.
- Return or waiting charges may apply.
- Replacement costs may apply.
- Perishable or personalized products may not be refundable.
A safe drop will only be made when authorized or reasonably appropriate.
Weather-sensitive, valuable or food products will not be left in an unsafe location.
Proof of an attempted or completed delivery may include:
- Delivery time
- GPS information
- Delivery photograph
- Driver notes
- Telephone-call records
- Safe-drop authorization
13. Recipient Refusal and Gifts
The purchaser is responsible for ensuring that the recipient is willing and able to receive the gift.
The following situations do not normally qualify for a refund:
- Recipient refusal
- Recipient does not recognize the sender
- Recipient is unavailable
- Disagreement between the purchaser and recipient
- Interpersonal disputes
- Dissatisfaction unrelated to product conformity
C&G will protect personal information and will not disclose purchaser information except as permitted by our Privacy Policy or required by law.
14. Refund Amount and Method
Approved refunds will be returned to the original payment method unless the customer agrees to another lawful resolution.
A partial refund may reflect:
- The affected product
- A missing component
- The delivery fee
- The demonstrated reduction in product value
- The portion of the order that could not be fulfilled
Gift cards or store credit will not replace a monetary refund when a monetary refund is required by law.
C&G aims to initiate an approved refund within five business days.
Banks, credit-card companies and payment processors may require additional time to post the refund. This commonly takes another 5 to 10 business days but may take longer depending on the financial institution.
Original delivery charges will normally be refunded when:
- The delivery service itself materially failed.
- C&G cancelled the delivery.
- A refund of the delivery charge is otherwise required by law.
Delivery charges are not normally refunded for:
- A change of mind
- Incorrect customer information
- Recipient unavailability
- Recipient refusal
- A failed delivery caused by the customer or recipient
15. Promotional Products, Bundles and Gifts With Purchase
A remedy involving one component of a bundle will consider the bundle’s combined price and value rather than the affected component’s individual retail price.
If the entire order is refunded, an unused promotional product or gift with purchase may need to be returned when reasonably practical.
Discounts, coupons and credits will be allocated proportionally when calculating a partial refund.
16. Fraud, Abuse and Duplicate Remedies
C&G may decline a claim involving:
- Altered or false evidence
- Repeated policy misuse
- Intentional product damage
- False non-delivery reports
- Payment fraud
- Other dishonest conduct
Any decision will remain subject to applicable law.
A customer may not receive duplicate recovery for the same loss through:
- A C&G refund
- A replacement
- A credit-card dispute
- An insurer
- Another payment or compensation source
This provision does not prevent a customer from exercising a lawful payment dispute or consumer remedy.
17. Ontario Online-Consumer Rights
Ontario law may provide cancellation or refund rights for certain internet agreements, including situations where:
- Required information was not provided.
- A copy of the agreement was not provided.
- Delivery did not occur within the legally applicable period.
- An unfair practice occurred.
- Another statutory cancellation right applies.
These rights depend on the circumstances and the law in force at the time of the transaction. They are not replaced or restricted by this policy.
C&G will provide electronic order confirmation and will honour mandatory statutory rights.

We aim to acknowledge customer-service requests promptly. Complex matters may require consultation with a vendor, delivery partner, payment processor or insurer.
19. Policy Changes
C&G may update this policy prospectively.
The version displayed or linked at checkout when an order is placed will generally apply to that order, subject to mandatory legal requirements.
Material changes will be identified through a revised effective date.
Customers should retain their order confirmation and applicable policy link for their records.
