CelebrateAndGift.com (“CelebrateAndGift”, “C&G”, “we”, “us”, or “our”) provides and coordinates local delivery for gifts, flowers and celebration products ordered through CelebrateAndGift.com.
Our goal is to provide reliable, professional and carefully handled delivery while recognizing that products such as fresh flowers, gift baskets, chocolates, sweets, cakes and personalized gifts may have different preparation and transportation requirements.
This Delivery Policy explains our delivery areas, delivery windows, same-day delivery rules, recipient responsibilities, failed-delivery procedures, proof of delivery, delays, redelivery and other delivery-related conditions.
This Policy forms part of the terms applicable to orders placed through CelebrateAndGift.com.
Nothing in this Policy limits any consumer right or remedy that cannot legally be restricted under applicable Ontario or Canadian law.
1. Delivery Service
CelebrateAndGift provides or coordinates delivery of eligible products purchased through CelebrateAndGift.com.
Depending on the order, delivery may involve:
- An approved vendor preparing the product;
- A CelebrateAndGift delivery partner collecting the prepared order;
- Transportation to the recipient’s address;
- Delivery to the recipient, authorized person or approved delivery location; and
- Recording delivery status and, where appropriate, proof of delivery.
Customers purchasing through CelebrateAndGift should contact CelebrateAndGift, rather than the individual vendor or driver, regarding delivery questions or problems unless we instruct otherwise.
2. Delivery Service Area
CelebrateAndGift initially provides delivery within selected areas of the Greater Toronto Area (“GTA”), Ontario.
Our service area may include locations such as:
- Brampton;
- Mississauga;
- Toronto;
- Etobicoke;
- Vaughan;
- Markham;
- Richmond Hill;
- Milton;
- Oakville;
- Burlington; and
- Other selected GTA locations.
Not every product or vendor will necessarily be available for delivery to every location.
Delivery availability depends on factors such as:
- Vendor location;
- Customer delivery address;
- Product;
- Preparation requirements;
- Distance;
- Driver availability;
- Delivery capacity;
- Delivery date;
- Weather;
- Order volume; and
- Operational feasibility.
The delivery options displayed during checkout are intended to indicate the options available for the particular order.
3. Delivery Zones
CelebrateAndGift may divide its delivery area into different delivery zones.
For example:
Local Delivery Zone
Locations near the fulfilling vendor or C&G delivery area.
Extended Delivery Zone
Locations requiring additional travel distance or time.
Special Delivery Zone
Certain distant, difficult-access or higher-cost locations that may require separate approval or additional charges.
Delivery-zone boundaries and charges may change as our delivery network develops.
4. Delivery Charges
Delivery charges may vary depending on:
- Delivery distance;
- Delivery zone;
- Product;
- Vendor location;
- Delivery speed;
- Same-day delivery;
- Order size;
- Special handling;
- Multiple delivery attempts;
- Peak periods; or
- Other delivery requirements.
The applicable delivery charge will normally be displayed before the customer completes payment.
Unless expressly stated otherwise, delivery charges are separate from the product price.
5. Delivery Fee Does Not Automatically Include Unlimited Attempts
A standard delivery fee normally covers one reasonable delivery attempt to the delivery address supplied by the customer.
Additional charges may apply where:
- A second delivery attempt is required;
- The customer changes the delivery address after dispatch;
- The original address is incorrect;
- The recipient cannot be reached;
- Building access is unavailable;
- The customer requests redirection;
- The order needs to be returned and redelivered; or
- Another issue outside C&G’s reasonable control creates additional delivery costs.
No additional fee will normally be charged for redelivery where a confirmed failed delivery was caused primarily by C&G’s own error.
6. Delivery Dates
Customers may be able to select or request a delivery date during checkout.
A requested delivery date is subject to:
- Product availability;
- Vendor confirmation;
- Preparation time;
- Delivery capacity;
- Driver availability;
- Delivery location; and
- Other operational considerations.
An order should not be treated as guaranteed for a specific date until the order has been accepted and the requested delivery can reasonably be fulfilled.
7. Delivery Windows
CelebrateAndGift generally uses delivery windows rather than exact appointment times.
For example, available windows may eventually include:
- Morning;
- Afternoon;
- Evening; or
- Defined multi-hour delivery windows.
The actual windows displayed on CelebrateAndGift.com will control.
Delivery windows help us:
- Group deliveries efficiently;
- Reduce delivery costs;
- Manage GTA traffic;
- Coordinate multiple vendors;
- Accommodate preparation times; and
- Provide more reliable service.
8. Exact Delivery Times
Unless CelebrateAndGift expressly sells or confirms a specific guaranteed-time delivery service, a delivery time requested by the customer is a preference rather than a guarantee.
For example, a request such as:
“Please deliver exactly at 6:00 p.m.”
will not create a guaranteed 6:00 p.m. delivery unless C&G expressly confirms that arrangement.
Customers should choose an available delivery window that reasonably suits their needs.
9. Special-Time Requests
Customers may provide special timing instructions where an order form permits them.
We will make reasonable efforts to consider those instructions, but cannot guarantee them unless expressly confirmed.
Examples include:
- “Please deliver after 5 p.m.”;
- “Recipient finishes work at 4 p.m.”;
- “Please avoid school pickup time”; or
- “Call before arriving.”
Such instructions assist delivery planning but do not necessarily create a guaranteed delivery appointment.
10. Same-Day Delivery
Same-day delivery may be available for selected:
- Products;
- Vendors;
- Delivery areas;
- Days;
- Order times; and
- Delivery windows.
Same-day availability may depend on:
- Product preparation time;
- Vendor capacity;
- Product inventory;
- Driver availability;
- Delivery distance;
- Traffic;
- Weather; and
- Existing delivery volume.
Same-day delivery should not be assumed merely because a product appears on the website.
The option must be available for the customer’s particular order or otherwise confirmed by CelebrateAndGift.
11. Same-Day Delivery Cut-Off Time
CelebrateAndGift may establish a daily same-day order cut-off time.
Orders placed after the cut-off may be:
- Offered next-day delivery;
- Offered another available date; or
- Accepted for same-day delivery only where operationally possible.
Cut-off times may differ by:
- Product;
- Vendor;
- Delivery area;
- Holiday;
- Season; or
- Order volume.
The current checkout information or product listing will control where a cut-off is displayed.
12. Same-Day Delivery During Peak Periods
Same-day delivery may be limited or unavailable during high-demand periods such as:
- Valentine’s Day;
- Mother’s Day;
- Father’s Day;
- Rakhi;
- Diwali;
- Christmas;
- New Year’s;
- Graduation periods; and
- Other major celebrations.
During peak periods, we may:
- Reduce available delivery windows;
- Close same-day ordering earlier;
- Limit certain delivery zones;
- Restrict product availability; or
- Reach daily delivery capacity.
Customers are encouraged to order early for major occasions.
13. Next-Day and Scheduled Delivery
Where available, customers may schedule delivery for a future date.
Scheduled delivery remains subject to:
- Product availability;
- Vendor availability;
- Delivery-area eligibility; and
- Operational capacity.
If circumstances prevent fulfilment on the requested date, C&G will contact the customer where reasonably possible and offer an appropriate resolution.
14. Preparation Time
Different products require different preparation times.
For example:
Flowers
May require sourcing, conditioning and arrangement.
Gift baskets
May require assembly, wrapping and quality checking.
Personalized products
May require printing, engraving or customization.
Cakes and desserts
May require advance preparation.
Customers should consider the preparation time shown for a product when selecting a delivery date.
15. Multiple Vendors
An order may sometimes contain products fulfilled by more than one vendor.
Where this occurs, CelebrateAndGift may:
- Coordinate the items before final delivery;
- Arrange separate pickups;
- Arrange separate deliveries where appropriate; or
- Contact the customer if the original delivery plan cannot reasonably be fulfilled.
Where possible, C&G will try to provide a convenient customer experience rather than requiring the customer to coordinate multiple vendors.
16. Customer Responsibility for Delivery Information
Customers are responsible for providing accurate and complete delivery information.
This includes:
- Recipient’s full name;
- Recipient telephone number;
- Street address;
- Unit or apartment number;
- City;
- Postal code;
- Building information;
- Buzz or access code where appropriate;
- Delivery instructions; and
- Other information reasonably necessary to complete delivery.
Customers should review this information carefully before placing an order.
17. Recipient Telephone Number
A working recipient telephone number is strongly recommended and may be required for certain deliveries.
The recipient’s number may be used only where reasonably necessary for delivery purposes, such as:
- Confirming availability;
- Finding the location;
- Requesting building access;
- Clarifying instructions; or
- Resolving a delivery problem.
Drivers should not use recipient contact information for unrelated purposes.
18. Surprise Gifts
Customers may request that a gift remain a surprise.
We will make reasonable efforts to preserve the surprise.
However, successful delivery takes priority.
If necessary, C&G or the delivery partner may contact the recipient to:
- Confirm the address;
- Obtain access;
- Confirm availability; or
- Complete delivery.
We may attempt to avoid revealing detailed gift contents when contacting the recipient.
19. Customer Telephone Availability
The customer should remain reasonably reachable on the delivery day, particularly for:
- Same-day orders;
- Surprise deliveries;
- Apartments and condos;
- Difficult-to-access addresses;
- Recipient-unavailable situations; and
- Address problems.
Failure to respond may result in delayed or unsuccessful delivery.
20. Apartments and Condominiums
For apartment or condominium deliveries, customers should provide:
- Unit number;
- Buzz code;
- Concierge instructions;
- Building name where useful;
- Parking or access information where necessary; and
- Recipient telephone number.
Drivers may be unable to wait for an extended period if building access is unavailable.
21. Concierge and Reception Delivery
Where permitted, an order may be delivered to:
- Concierge;
- Reception;
- Front desk;
- Security;
- Office administrator; or
- Another authorized person at the delivery address.
Delivery to such a person may constitute successful delivery where that person reasonably appears authorized to accept items for the recipient.
22. Office and Workplace Deliveries
Customers should provide appropriate workplace information, including where applicable:
- Business name;
- Department;
- Floor;
- Suite;
- Reception information; and
- Recipient telephone number.
The customer should ensure that the workplace accepts personal deliveries.
CelebrateAndGift is not responsible where a workplace legitimately refuses entry or delivery contrary to information provided by the customer.
23. Hospitals and Healthcare Facilities
Hospital, long-term-care, rehabilitation and other healthcare-facility deliveries may be subject to facility rules.
Customers should verify:
- Patient name;
- Unit or room;
- Facility address;
- Visiting or delivery restrictions;
- Whether flowers are permitted; and
- Whether food products are permitted.
Some units may prohibit:
- Flowers;
- Latex products;
- Certain foods; or
- Outside deliveries.
C&G cannot guarantee access where a facility restricts delivery.
24. Schools and Educational Institutions
Deliveries to schools or similar institutions may be subject to security and visitor restrictions.
An order may need to be delivered to:
- Main office;
- Reception;
- Security; or
- Another authorized location.
Customers are responsible for confirming that the institution accepts deliveries.
25. Hotels
For hotel deliveries, customers should provide:
- Hotel name;
- Guest name;
- Hotel address;
- Room number, if known; and
- Reservation information where reasonably required.
Some hotels may require the order to be left at reception.
26. Gated Communities and Restricted Properties
Customers are responsible for providing necessary access instructions for:
- Gated communities;
- Security-controlled properties;
- Private buildings; and
- Restricted areas.
If access cannot be obtained, delivery may be treated as unsuccessful.
27. Driver Arrival
Depending on the circumstances, a driver may:
- Ring the doorbell;
- Knock;
- Call the recipient;
- Send an authorized delivery notification;
- Contact the customer; or
- Follow specific instructions provided with the order.
Drivers are not normally expected to remain at an address for an extended period.
28. Reasonable Waiting Time
Because drivers may have several scheduled deliveries, waiting time at an address is limited.
If:
- The recipient does not answer;
- Building access cannot be obtained;
- Customer cannot be reached; or
- Delivery instructions cannot be completed,
the driver may need to continue to the next delivery.
CelebrateAndGift may then determine whether safe drop, return or redelivery is appropriate.
29. Safe-Drop Delivery
Where appropriate, an order may be left in a reasonably safe location.
Examples may include:
- At the front door;
- On a covered porch;
- With concierge;
- With reception;
- At another location specifically authorized by the customer or recipient.
Safe drop will only be used where reasonably appropriate for the product and circumstances.
30. Products Unsuitable for Safe Drop
Some products may not be suitable for unattended delivery, particularly where there is risk from:
- Extreme heat;
- Extreme cold;
- Direct sunlight;
- Rain;
- Snow;
- Animals;
- Theft;
- Product sensitivity; or
- Food-safety concerns.
C&G or the driver may decline to leave such an order unattended.
31. Customer-Requested Safe Drop
If the customer specifically instructs C&G to leave an order unattended, we may follow those instructions where reasonably safe and appropriate.
Examples:
“Leave at front door if no answer.”
“Leave with concierge.”
“Leave inside porch.”
Once an order has been properly delivered according to the customer’s authorized safe-drop instructions, CelebrateAndGift generally cannot be responsible for events occurring afterward, such as:
- Theft;
- Weather exposure;
- Heat damage;
- Freezing;
- Animals;
- Movement by third parties; or
- Other events occurring after successful delivery,
except where applicable law provides otherwise.
32. Safe-Drop Discretion
Even where the customer requests safe drop, a driver may decide not to leave an order if doing so would create an unreasonable risk.
For example:
- No secure location is available;
- Weather is severe;
- The product is highly perishable;
- Building rules prohibit it;
- Driver cannot verify the correct address; or
- Leaving the order would obviously expose it to damage.
33. Delivery to Another Person
Where the recipient is unavailable, the order may be delivered to another person reasonably authorized to accept it, such as:
- Household member;
- Concierge;
- Receptionist;
- Front-desk employee; or
- Other person designated by the customer or recipient.
The person may be asked to confirm receipt where appropriate.
34. Proof of Delivery
CelebrateAndGift may collect proof of delivery.
Proof may include:
- Delivery date;
- Delivery time;
- Delivery status;
- GPS or location information associated with delivery;
- Driver confirmation;
- Name or confirmation of receiving person where appropriate;
- Photograph of the delivered package or location; and
- Other delivery-management information.
Proof of delivery may be stored through Shipday or another delivery-management platform.
35. Delivery Photographs
Where a delivery photograph is taken, it should focus on establishing where the order was delivered.
Drivers should avoid unnecessarily photographing:
- Recipient’s face;
- Children;
- Inside of homes;
- Identification documents;
- Vehicle licence plates;
- Neighbouring properties; or
- Unrelated private information.
Delivery photographs are handled according to our Privacy Policy.
36. Delivery Tracking
Where available, customers or recipients may receive:
- Delivery-status notifications;
- Tracking links;
- Estimated arrival information; or
- Delivery confirmation.
Tracking information is an operational estimate and may change because of:
- Traffic;
- Route adjustments;
- Other deliveries;
- Driver availability; or
- Unexpected circumstances.
37. Use of Shipday
CelebrateAndGift may use Shipday or another delivery-management platform for:
- Dispatch;
- Driver assignment;
- Route management;
- Driver navigation;
- Customer or recipient contact;
- Delivery tracking;
- Status updates; and
- Proof of delivery.
Use of such platforms may involve sharing limited information necessary to complete delivery.
This is further described in our Privacy Policy.
38. Delivery Statuses
Customers may see delivery statuses such as:
Order Confirmed
→ Preparing
→ Ready for Pickup
→ Driver Assigned
→ Picked Up
→ Out for Delivery
→ Delivered
Additional statuses may be used where appropriate.
A status is intended to provide operational information and may not update instantly in every situation.
39. Failed Delivery
A delivery may be considered unsuccessful where:
- Recipient cannot be reached;
- Customer cannot be reached;
- Address is incorrect;
- Address is incomplete;
- Unit number is missing;
- Access code is missing;
- Building access is denied;
- Recipient refuses delivery;
- Property cannot reasonably be located;
- Delivery would be unsafe;
- Safe drop is inappropriate; or
- Another circumstance prevents reasonable completion.
40. Failed Delivery Due to Customer Information
Where delivery cannot be completed because the customer supplied incorrect or incomplete information, the customer may be responsible for:
- Redelivery fee;
- Additional distance charges;
- Return-to-vendor costs;
- Replacement of perishable products where necessary; and
- Other reasonable costs created by the failed attempt.
Examples include:
- Wrong address;
- Wrong postal code;
- Missing apartment number;
- Incorrect phone number; or
- Missing access information.
41. Recipient Unavailable
If the recipient is unavailable, the driver may attempt one or more of the following where appropriate:
- Call the recipient;
- Contact the customer;
- Attempt reasonable building access;
- Leave with concierge or authorized person;
- Complete authorized safe drop; or
- Mark delivery as unsuccessful.
The appropriate response will depend on the product and delivery circumstances.
42. Recipient Refuses Delivery
If the recipient refuses to accept a gift, C&G may contact the customer.
The customer may choose, where possible, to:
- Redirect the order;
- Request redelivery;
- Arrange another solution; or
- Allow C&G to close the delivery attempt.
Additional charges may apply.
A recipient’s refusal does not automatically make the customer eligible for a refund, particularly for fresh, perishable, customized or personalized products.
Our Refund, Cancellation & Replacement Policy will apply.
43. Redelivery
Where an order cannot be successfully delivered, redelivery may be available.
Redelivery depends on:
- Product condition;
- Product perishability;
- Driver capacity;
- Vendor availability;
- Delivery distance;
- Time of day; and
- Reason for the first failed attempt.
A new delivery fee may apply where the initial failure was not caused by C&G.
44. Same-Day Redelivery
Same-day redelivery cannot be guaranteed.
If capacity permits, we may attempt same-day redelivery.
Otherwise, C&G may arrange another appropriate delivery time.
Fresh or perishable products may need to be replaced if they can no longer be safely or reasonably delivered.
45. Change of Address Before Dispatch
Customers should contact us immediately if the delivery address needs to change.
If the order has not been dispatched, we will attempt to update the delivery address.
An additional charge may apply if the new location falls within a more expensive delivery zone.
46. Change of Address After Dispatch
Changing an address after a driver has collected the order may not be possible.
If C&G agrees to redirect the delivery, additional charges may apply based on:
- Additional distance;
- Travel time;
- Route disruption; or
- Delivery zone.
If redirection cannot reasonably be accommodated, another delivery arrangement may be required.
47. Customer Changes Delivery Date
Customers should request a delivery-date change as early as possible.
Changes may not be possible once:
- Product preparation has started;
- Fresh flowers have been arranged;
- Perishable goods have been prepared;
- Vendor fulfilment is complete; or
- Driver dispatch has begun.
Additional product or delivery costs may apply where rescheduling creates additional costs.
48. Early Delivery
C&G will aim to deliver within the selected delivery window.
Where operational circumstances require a substantially earlier delivery, we may attempt to contact the customer or recipient.
Delivery slightly earlier within a reasonable period does not necessarily constitute delivery failure.
49. Late Delivery
Traffic, weather, vendor preparation, accidents and other operational issues can cause delays.
A delivery arriving later than the estimated time but still reasonably connected to the selected delivery arrangement does not automatically qualify for a refund.
However, where a delay is substantial, contact CelebrateAndGift and we will assess:
- Cause of delay;
- Occasion;
- Product;
- Delivery commitment;
- Impact on the customer; and
- Applicable consumer rights.
50. Material Delivery Failure
A delivery issue may be considered material where, for example:
- The order was delivered on the wrong day because of C&G’s error;
- The driver delivered to the wrong verified address;
- The product was lost during C&G-controlled delivery;
- C&G failed to complete a confirmed delivery without reasonable cause; or
- Delay substantially defeated the purpose of a clearly time-sensitive order.
Where C&G is responsible for a material delivery failure, we will assess an appropriate remedy under our Refund, Cancellation & Replacement Policy.
51. Wrong-Address Delivery Caused by C&G
If the customer provided the correct address but the order was delivered to the wrong address because of C&G’s delivery error, C&G will investigate.
Where confirmed, an appropriate remedy may include:
- Recovery and redelivery where suitable;
- Replacement;
- Redelivery;
- Partial refund; or
- Full refund.
The customer will not normally be charged an additional delivery fee to correct a confirmed C&G delivery error.
52. Lost Orders
If a delivery is reported as missing, CelebrateAndGift may review:
- Driver GPS information;
- Delivery timestamp;
- Proof-of-delivery photograph;
- Address;
- Driver communications;
- Recipient communications; and
- Other delivery records.
If C&G confirms that the product was lost before successful delivery, we will provide an appropriate remedy.
53. Theft After Successful Delivery
If C&G has properly completed an authorized safe-drop delivery and proof reasonably establishes delivery to the correct location, C&G may not be responsible for theft occurring afterward.
Customers should choose attended delivery where theft risk is a concern.
We will nevertheless review credible reports of missing deliveries to determine whether the delivery was correctly completed.
54. Damaged During Delivery
Drivers are expected to handle gifts carefully.
Products such as:
- Flowers;
- Cakes;
- Gift baskets;
- Chocolates;
- Glass containers;
- Decorative arrangements; and
- Personalized products
may require special handling.
If an order is materially damaged while under C&G delivery control, contact us promptly.
We may request photographs and will investigate the problem.
Where verified, an appropriate remedy will be provided according to our Refund, Cancellation & Replacement Policy.
55. Flower Handling
Fresh flowers should be transported in a manner reasonably intended to:
- Keep arrangements upright;
- Protect flowers from crushing;
- Reduce excessive temperature exposure;
- Avoid unnecessary movement; and
- Preserve presentation.
Customers and recipients should follow applicable flower-care instructions after delivery.
56. Food and Chocolate Handling
Where appropriate, delivery personnel should take reasonable care to protect edible products from:
- Excessive heat;
- Extreme cold;
- Crushing;
- Contamination; and
- Unnecessary delay.
Once successfully delivered, proper storage becomes the recipient’s responsibility.
57. Cake and Fragile Product Delivery
Where cakes or other fragile items are offered, special handling requirements may apply.
These products should be:
- Kept reasonably level;
- Protected from sudden movement;
- Protected from excessive heat;
- Handled carefully; and
- Delivered according to available storage instructions.
58. Extreme Heat
Hot weather can affect:
- Flowers;
- Chocolates;
- Cakes;
- Certain food products; and
- Other temperature-sensitive products.
During extreme heat, C&G may:
- Adjust delivery routing;
- Avoid unsafe unattended delivery;
- Contact the recipient;
- Reschedule where necessary; or
- Use other reasonable protective measures.
59. Extreme Cold
Cold temperatures may damage some flowers and other products.
During extreme cold, a driver may decline to leave temperature-sensitive products outdoors unattended.
If no appropriate recipient or safe indoor location is available, delivery may need to be rescheduled.
60. Severe Weather
Delivery may be delayed, restricted or suspended where conditions create an unreasonable safety risk.
Examples include:
- Snowstorms;
- Freezing rain;
- Flooding;
- Severe thunderstorms;
- Extreme weather warnings;
- Dangerous road conditions; or
- Major transportation disruptions.
Safety of customers, recipients, vendors and drivers takes priority over delivery speed.
61. Weather-Related Rescheduling
Where severe weather prevents safe delivery, CelebrateAndGift may contact the customer to arrange:
- Later delivery;
- Another delivery window;
- Next-day delivery;
- Product replacement where perishability requires it; or
- Another reasonable solution.
No provision in this Policy overrides applicable consumer rights.
62. Traffic and Road Conditions
GTA delivery times may be affected by:
- Traffic congestion;
- Accidents;
- Construction;
- Road closures;
- Parades;
- Major events;
- Public transit disruptions; or
- Other transportation conditions.
Estimated arrival times should therefore not be treated as exact guarantees unless expressly confirmed.
63. Vendor Preparation Delays
Because C&G works with local vendors, a vendor may occasionally require additional preparation time.
If this could materially affect delivery, CelebrateAndGift will make reasonable efforts to:
- Obtain an updated preparation time;
- Adjust driver dispatch;
- Notify the customer where appropriate; and
- Provide a reasonable solution.
64. Driver Availability
Delivery capacity depends in part on driver availability.
C&G may limit:
- Same-day orders;
- Delivery zones;
- Delivery windows; or
- Daily order volume
where insufficient delivery capacity exists.
It is preferable for C&G to close unavailable delivery windows rather than accept orders we cannot reasonably fulfil.
65. Maximum Daily Delivery Capacity
CelebrateAndGift may establish maximum daily delivery capacity.
Once capacity has been reached, customers may be offered:
- Another delivery window;
- Another delivery date; or
- Alternative available products/vendors.
This helps maintain reliable service and product quality.
66. Holidays and Peak Events
Delivery times and capacity may differ on holidays and major gifting occasions.
These may include:
- Valentine’s Day;
- Mother’s Day;
- Father’s Day;
- Rakhi;
- Diwali;
- Christmas;
- New Year’s Eve;
- New Year’s Day; and
- Other high-volume occasions.
Special delivery schedules, cut-off times and fees may apply.
67. Delivery Instructions
Customers may provide reasonable delivery instructions.
Examples include:
- “Call on arrival”;
- “Leave with concierge”;
- “Use side entrance”;
- “Do not ring bell”;
- “Leave at front door if no answer.”
We will attempt to follow reasonable instructions.
Instructions that are:
- Unsafe;
- Illegal;
- Impractical;
- Inconsistent with building rules; or
- Likely to damage the product
may not be followed.
68. Unsafe Delivery Locations
Drivers are not required to enter locations or situations they reasonably believe to be unsafe.
Delivery may be stopped or rescheduled where there is a reasonable safety concern involving:
- Aggressive animals;
- Threatening individuals;
- Unsafe property conditions;
- Dangerous weather;
- Hazardous roads;
- Restricted areas; or
- Other safety risks.
69. Pets
Customers should ensure that pets do not create a risk to the driver.
Where a loose or aggressive animal prevents safe access, the driver may decline to approach the door.
Another delivery arrangement may be required.
70. Driver Entry Into Homes
C&G delivery personnel are generally expected to deliver to the door, concierge, reception or other designated handoff location.
Drivers are not normally required to enter a customer’s or recipient’s home.
This protects:
- Customer privacy;
- Driver safety;
- Product security; and
- Clear proof-of-delivery procedures.
71. Setup or Installation
Unless a product or service specifically includes setup, the delivery fee does not include:
- Decorating a room;
- Installing decorations;
- Arranging furniture;
- Setting up an event;
- Assembling large products; or
- Other on-site services.
Such services, if introduced later, will be governed by separate service terms.
72. Pickup Option
If CelebrateAndGift later offers customer pickup for selected products, pickup availability may depend on:
- Vendor;
- Product;
- Pickup location;
- Preparation time; and
- Operating hours.
Customers should not visit a vendor location unless C&G has confirmed pickup instructions.
73. Driver Tips
If tipping is offered through the website or delivery system, tips may be optional unless otherwise clearly disclosed.
The availability and processing of tips may depend on the delivery platform in use.
74. Customer Privacy During Delivery
Delivery personnel may receive only information reasonably necessary to perform the delivery, such as:
- Recipient name;
- Telephone number;
- Address;
- Delivery instructions; and
- Order-identification details.
Drivers should not use this information for personal marketing or unrelated contact.
For more information, see our Privacy Policy.
75. Vendor Privacy
Vendors should receive only the information reasonably necessary to prepare or fulfil their assigned order.
C&G aims to maintain control over the customer relationship.
Vendors should not independently use customer information obtained through CelebrateAndGift for unauthorized marketing.
76. Delivery Complaints
If you experience a delivery problem, contact CelebrateAndGift as soon as reasonably possible.
Please provide:
- Order number;
- Customer name;
- Recipient name;
- Delivery address;
- Description of the problem; and
- Photographs where relevant.
For missing or damaged deliveries, prompt reporting helps us investigate driver and delivery records.
77. Delivery Damage Claims
Where a delivery arrives materially damaged, customers should follow our Refund, Cancellation & Replacement Policy.
We may review:
- Product condition before pickup;
- Vendor photographs where available;
- Driver handling;
- Delivery route;
- Packaging;
- Delivery photograph; and
- Customer photographs.
This helps determine where damage occurred.
78. Delivery Fee Refunds
Delivery charges may be refunded where appropriate, such as where:
- C&G accepted payment for delivery but cancelled the service;
- No delivery attempt was made because of C&G’s error;
- A material delivery failure attributable to C&G occurred; or
- Applicable law requires a refund.
Delivery fees will generally not be refunded simply because:
- Recipient was unavailable;
- Customer provided incorrect information;
- Successful delivery occurred;
- Recipient refused the gift;
- Customer requested an unnecessary second attempt; or
- A minor delay occurred.
79. Customer-Caused Redelivery Costs
Where a new delivery is required because of circumstances attributable primarily to the customer or recipient, additional charges may apply.
Examples include:
- Wrong address;
- Wrong unit number;
- Recipient unavailable;
- Recipient refused delivery;
- Missing access information;
- Customer requested destination change; or
- Customer requested another attempt after completed safe drop.
80. C&G-Caused Redelivery Costs
Where C&G confirms that redelivery is required because of our own material delivery error, we will normally bear the reasonable redelivery cost.
Examples include:
- Driver delivered to incorrect address despite correct information;
- C&G dispatch error;
- Order was damaged materially during delivery; or
- Delivery was incorrectly marked complete.
81. Delivery to Minors
Where appropriate, C&G may avoid handing certain products directly to an unattended young child.
Drivers may instead request an adult, guardian, concierge, receptionist or other appropriate person to accept the delivery.
Age-restricted products are not part of C&G’s intended MVP offering.
82. Identification
Ordinary gift deliveries generally should not require the recipient to provide government-issued identification unless reasonably necessary for a specific service or required by law.
If a future product legally requires age or identity verification, separate requirements will be disclosed before purchase.
83. Contactless Delivery
Contactless delivery may be available where appropriate.
This may involve:
- Leaving the order at an authorized location;
- Taking proof-of-delivery;
- Notifying the recipient; and
- Completing the order without physical handoff.
Contactless delivery remains subject to product-safety and weather considerations.
84. Delivery Communications
C&G, Shipday or our delivery personnel may send transactional communications related to an active delivery.
These may include:
- Driver assigned;
- Order picked up;
- Order out for delivery;
- Estimated arrival;
- Driver contacting recipient;
- Delivery complete; or
- Delivery problem.
These communications are operational and are not the same as promotional marketing communications.
85. Delivery Estimates
Any displayed estimated arrival time is an estimate.
It may change throughout the delivery because of:
- Traffic;
- Route sequencing;
- Vendor delays;
- Driver issues;
- Weather;
- Previous delivery stops; and
- Road conditions.
86. Force Majeure and Events Beyond Reasonable Control
CelebrateAndGift will not be responsible for unavoidable delays caused by events beyond our reasonable control to the extent permitted by law.
Examples may include:
- Natural disasters;
- Severe weather;
- Major emergencies;
- Government restrictions;
- Widespread telecommunications failures;
- Major road shutdowns;
- Civil emergencies; or
- Other exceptional circumstances.
C&G will make reasonable efforts to reduce disruption and provide customers with an appropriate alternative where possible.
87. No Waiver of Consumer Rights
Nothing in this Delivery Policy is intended to remove any consumer protection right that cannot legally be waived.
Where applicable Ontario law provides a customer with a right to cancel, obtain a refund or pursue another remedy because of non-delivery or another failure, that legal right will prevail over inconsistent language in this Policy.
88. Legally Significant Late Delivery
Applicable consumer-protection law may provide specific cancellation rights if a qualifying order is not delivered within the legally prescribed period after the agreed delivery date.
C&G will comply with applicable statutory delivery and refund obligations.
This Policy’s operational delivery-window provisions do not replace those statutory rights.
89. Online Order Information
Before completing an applicable internet order, customers should be provided with clear information concerning matters such as:
- Product;
- Price;
- Delivery charges;
- Applicable taxes;
- Delivery arrangements;
- Customer information;
- Recipient information; and
- Applicable conditions.
Customers should also have an opportunity to review and correct order information before completing the purchase where required by law.
90. Order Confirmation
After an order is placed, CelebrateAndGift will generally provide an electronic order confirmation.
Depending on the order, the confirmation may include:
- Order number;
- Product;
- Amount charged;
- Delivery address;
- Delivery date or window;
- Customer details; and
- Other relevant transaction information.
Customers should review the confirmation and contact us promptly if information is incorrect.
91. Responsibility After Successful Delivery
Once an order has been properly delivered to:
- Recipient;
- Authorized person;
- Concierge;
- Reception;
- Approved safe-drop location; or
- Other location expressly authorized by the customer,
the recipient or customer becomes responsible for reasonable care of the product.
This may include:
- Bringing flowers indoors;
- Refrigerating food where required;
- Protecting chocolates from heat;
- Properly storing cakes;
- Following care instructions; and
- Protecting the product from theft or environmental exposure.
92. Policy Relationship With Refund Policy
Delivery problems that may qualify for:
- Refund;
- Replacement;
- Partial refund;
- Redelivery; or
- Other remedy
are handled under the CelebrateAndGift Refund, Cancellation & Replacement Policy.
This Delivery Policy explains how delivery works.
The Refund, Cancellation & Replacement Policy explains the remedies available when something goes wrong.
